RELEASE AND INDEMNITY AGREEMENT –
In consideration for the right to use the Common Property in the Waterbury Cove community on THE DATE ABOVE, including but not limited to the Pavilion, Pool and Pool Cabana, I and all of my guests (NUMBER LISTED ABOVE) agree to release, covenant not
to sue, hold harmless and forever discharge Waterbury Cove Homeowners Association, Inc., (hereinafter the “Association”) its directors, officers, employees and members from all claims, demands, right and causes of action by reason of any and all known and
unknown, foreseen and unforeseen bodily and physical injury, damage to property, and any other consequences thereof which arise from or are in any way related to the aforementioned use of the Common Property. In addition, I and all of my guests
(NUMBER LISTED ABOVE) agree to indemnify and hold harmless the Association, its officers, directors, employees, agents, and members, present, past, and future, from any and all charges, claims costs, causes of action, damages and liabilities (including but not
limited to attorney's fees) for any and all injuries to either person or property, suffered by me, my family members, guests, employees, agents. servants, invitees, any member of the Association or any other person which arise from or are in any way related to the use
of the Common Property and other amenities in the Waterbury Cove community. Furthermore, I and all of my guests (NUMBER LISTED ABOVE) agree to be responsible, repair, replace and/or reimburse the Association for any and all damage caused by me,
my family members, my guests, employees, agents, servants, invitees, any member of the Association or any other person which arise from or are in any way related to the use of the common Property and other amenities in the Waterbury Cove community.
If using the pool in conjunction with the pavilion, please make sure all guests are aware that per Gwinnett County Ordinance (1) the gate MUST be kept closed and locked at all times and (2) NO glass is allowed in the pool or on the pool deck. All guests and
residents are required to abide by all pool rules posted inside the main pool entrance gate/hallway and detailed on the waterburycove.com website. Waterbury Cove Common Areas are smoke free zones. Only those over 18 years of age are allowed to smoke in the one designated smoking area located outside and to the right of the main gate entrance.


MAXIMUM 4 CONSECUTIVE HOURS RESERVATION AT A TIME. AREA MUST BE CLEANED BEFORE EXIT AND POOL FURNITURE MUST NOT BE MOVED. ABUSE SUBJECT TO FINES/LOSS OF USE.


I understand that, by signing this document BY AN ELECTRONIC DEVICE WHICH IS THE SAME AS MY SIGNATURE, I hereby acknowledge that I have read the above RELEASE AND INDEMNITY AGREEMENT carefully before signing and have notified all of my guests (NUMBER LISTED ABOVE) of the contents contained in this agreement.
